My husband is an Assistant Professor teaching at a university in China. Recently we were thinking about obtaining permanent residence in the U.S. I wonder if he is eligible to apply for a green card while he's not physically living/working inside the U.S.?
He can certainly apply for a green card from China!
He needs to file I-140 petition first. If his I-140 is approved, the next step for him is to obtain an immigrant visa from the U.S. consulate in China. But currently, EB1/EB2 visas should be retrogressed for him so he will have wait upon the I-140 approval.
