EB-1B for startup?

I work in a R&D position at a startup. We have five employees including myself and my employer is willing to sponsor my case. My boss does not understand the EB-1B process very well tho and I am worried that our company is not qualified to sponsor EB-1B. Can anyone provide some insight?

yeah you might have a problem cuz I think your employer needs to show that they have at least 3 full-time researchers. You might want to ask an immigration lawyer to make sure

yeah I agree with you. I have EB-1B approval and we have more than 3 researchers in the company

You should definitely make sure your company meets the requirements for EB1B. My case was denied because we don't have enough full-time researchers in our startup. Go find an experienced attorney to help you.
